In School Suspension Reporting:

Definition of In School Suspension (ISS):

  • Student is removed from an assigned class or activity to another setting in order to maintain an orderly and effective educational system.

  • During the removal to another setting, the suspension must meet the definition of ‘instructional time’ pursuant to IC 20-30-2-1.

  • If the instruction provided to a student who is suspended meets the definition of instructional time, the suspension should be reported as an in school suspension.

  • If the instruction provided to a student who is suspended DOES NOT meet the definition of instructional time, the suspension should be reported as an out of school suspension.

ISS reporting may include students removed from an assigned class or activity to a program where instruction will continue rather than sent home. This program may be within the same enrollment school building or another location within the LEA (corporation) boundaries but outside of the enrollment school building.

In School Suspension:

ISS reporting may include students removed from an assigned class or activity to a program where instruction will continue rather than sent home. Definition of In School Suspension (ISS):

  • Student is removed from an assigned class or activity to another setting in order to maintain an orderly and effective educational system.

  • During the removal to another setting, the suspension must meet the definition of ‘instructional time’ pursuant to IC 20-30-2-1.

  • If the instruction provided to a student who is suspended meets the definition of instructional time, the suspension should be reported as an in school suspension.

  • If the instruction provided to a student who is suspended DOES NOT meet the definition of instructional time, the suspension should be reported as an out of school suspension.

Instructional Time Definition:

  • Time in which students are participating in an approved course, curriculum or educationally related activity under the direction of a teacher.

    • NOTE: It is the responsibility of the local school or corporation to ensure the instruction provided meets the legal definition of “instructional time” (IC 20-30-2-1) which includes the criterion of being “under the direction of a teacher”.

  • Instructional time includes a reasonable amount of passing time between classes within a single school building or on a single school campus, but does not include lunch or recess.

  • Homework does not meet the criteria for “instructional time”.

NOTE: Students serving ISS are counted in the total number of days attended and should have their attendance reported as ‘in attendance’.

Out of School Suspension:

Definition of Out of School Suspension (OSS):

  • Students removed from an assigned class or activity to maintain an orderly and effective educational system and are not allowed in the building.

  • Students removed from an assigned class or activity to another setting located within the school corporation or building and DOES NOTmeet the definition of instructional time should be reported as an out-of-school suspension.

  • Students can be suspended while waiting on an expulsion hearing (IC 20-33-8-23).

  • Students may not be suspended from school pending a hearing on a student’s proposed expulsion if the expulsion is ordered for lack of legal settlement (IC 20-33-8-17).

  • Students eligible for special education are subject to Article 7, Rule 44.

NOTES:

  • Students serving OSS and are NOT receiving services are not counted in the total number of days attended.

  • Students serving OSS and are NOT receiving services should have their attendance reported as ‘suspended’.

  • Students serving OSS and are receiving services are counted in the total number of days attended.

  • Students serving OSS and are receiving services should have their attendance reported as ‘virtual’ if no face-to-face instruction is being provided.

  • Students serving OSS and are receiving services should have their attendance reported as ‘in attendance’ if face-to-face instruction is being provided.

Additional Reporting Guidance:

  • Students serving OSS pending an Expulsion

    • If the expulsion is upheld the student’s school association (enrollment) record will be provided with an end date reported as the first day of the suspension and exit code 33 = student serving an expulsion.

    • Suspension days are now considered Expelled days. Suspension attendance records should be updated from suspended to expelled.

    • Action record should be updated from Suspension to Expulsion to reflect data accurately.

Expulsion:

Definition of Expulsion:

  • Students removed from an educational setting to maintain an orderly and effective educational system and not allowed in the building.

Schools are still responsible for the students until they either formally withdraw to another educational setting, dropout, or return after serving the term of the expulsion.

Additional Reporting Guidance:

  • Students serving Expulsion but continue being educated WILL NOT have an end date on the student’s school association (enrollment) record with exit code 33.

NOTES:

  • Students serving Expulsion and are NOT receiving services are not counted in the total number of days attended.

  • Students serving Expulsion and are NOT receiving services should have their attendance reported as ‘expelled’.
